Terms of Service

By accessing or using the DataDriven platform, website, mobile applications, APIs, or any related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are accessing the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you must discontinue use of the Service immediately.

DataDriven, Inc. is a venture-backed workforce development company. Our mandate is to maximize the number of interview-ready data engineers entering the workforce by providing high-quality, accessible interview preparation infrastructure.

The Service is currently provided at no cost to individual candidates as part of our mission to close the preparation gap in data engineering hiring. This open-access model is a strategic decision aligned with our investors and board, not a promotional period. We reserve the right to introduce additional paid services in the future; however, any changes to the accessibility of existing features will be communicated with at least ninety (90) days' written notice.

DataDriven is an interactive platform for data engineering interview preparation. The Service includes, without limitation:

• Structured learning content across SQL, Python, data modeling, and pipeline architecture
• Coding challenges with real-time execution and automated grading
• Interview simulations calibrated to company-specific patterns
• Adaptive difficulty and spaced repetition systems
• Skill assessments and readiness scoring
• Career resources and interview strategy content

The Service is delivered through web applications at datadriven.io and mobile applications available on supported platforms. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

The Service is intended for individuals who are at least eighteen (18) years of age or the age of majority in their jurisdiction, whichever is greater. By using the Service, you represent and warrant that you meet these eligibility requirements.

The Service is available globally, subject to applicable export controls and sanctions. You are responsible for compliance with local laws governing your use of the Service.

Certain features of the Service require account registration. When creating an account, you agree to provide accurate, current, and complete information and to update such information as necessary. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You may authenticate via Google OAuth, LinkedIn OAuth, or email and password. One individual may not maintain more than one active account. We reserve the right to refuse registration or cancel accounts at our discretion.

You must notify DataDriven immediately at support@datadriven.io if you become aware of any unauthorized use of your account.

You agree to use the Service solely for its intended purpose: personal interview preparation and professional development. You shall not:

• Use the code execution environment for any purpose unrelated to completing challenges or practicing skills
• Attempt to access, probe, or test the vulnerability of any DataDriven system, or breach any security or authentication measures
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
• Use automated tools, scripts, bots, or scrapers to interact with the Service
• Upload malicious code, attempt to escape the sandbox environment, or interfere with the operation of the Service
• Redistribute, republish, or commercially exploit challenge content, lesson material, assessment data, or expected solutions
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use the Service to develop a competing product or service
• Circumvent any access controls, rate limits, or usage restrictions

Violation of this policy may result in immediate suspension or termination of your account without notice.

You are solely responsible for the code you submit for execution. DataDriven assumes no liability for the behavior or output of user-submitted code.

DataDriven reserves the right to enforce usage limits and restrict access to maintain platform integrity and detect abuse.

All content available through the Service, including but not limited to lesson text, challenge designs, expected solutions, assessment algorithms, grading logic, user interface design, graphics, and platform source code, is the exclusive property of DataDriven, Inc. or its licensors and is protected by applicable intellectual property laws.

You retain full ownership of original code you write within the editors. By submitting code for execution, you grant DataDriven a limited, non-exclusive, royalty-free license to process that code solely for the purpose of providing the Service (grading, execution, and result display).

You may not reproduce, distribute, publicly display, create derivative works from, or commercially exploit any DataDriven content without prior written permission. This includes, without limitation, challenge prompts, lesson material, solution explanations, and assessment rubrics.

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information. Key commitments:

• All data is encrypted at rest and in transit using industry-standard protocols
• We do not sell, rent, or trade personal data to third parties
• Data handling practices are aligned with GDPR and applicable data protection frameworks
• You may submit requests regarding your personal data, which we'll handle in accordance with applicable law
• Infrastructure security controls are subject to third-party audit

The Service may integrate with or contain links to third-party services, including authentication providers (Google, LinkedIn), analytics platforms, and payment processors. Your use of third-party services is governed by their respective terms and privacy policies. DataDriven is not responsible for the content, privacy practices, or availability of third-party services.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

DataDriven does not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. DataDriven does not guarantee any specific interview outcomes, employment results, or career advancement as a result of using the Service.

Content on the platform is provided for educational and preparation purposes only and does not constitute professional career advice, legal advice, or employment guarantees.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DATADRIVEN, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, INVESTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

IN NO EVENT SHALL DATADRIVEN'S TOTAL AGGREGATE LIABILITY EXCEED ONE HUNDRED DOLLARS (USD $100.00) OR THE AMOUNT YOU PAID DATADRIVEN IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless DataDriven, Inc. and its officers, directors, employees, agents, investors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit through the Service.

We reserve the right to suspend or terminate your access to the Service, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

You may stop using the Service at any time. For requests relating to your account or stored information, contact support@datadriven.io and we'll respond in accordance with applicable law. Some information may be retained where we have a legal basis or legitimate operational need to keep it, including to comply with legal obligations or resolve disputes.

Sections 8, 11, 12, 13, and 15 shall survive termination of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Wilmington, Delaware, unless the parties agree otherwise.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or other representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration.

DataDriven reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Effective date" above. For material changes that affect your rights or obligations, we will provide at least thirty (30) days' advance notice via email or in-app notification.

Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.
